Filing Requirements
1. Power of attorney, simply signed.
2. 3 copies of the specifications and claims in English.
3. 3 sets of formal drawings.
4. Copy of PCT Request.
5. Copy of International Publication.
6. Copy of International Search Report.
7. Copy of International Preliminary Examination Report (if available).
Items 2 and 3 as well as items 4-7 must be submitted at the time of filing. Documents 1 may be submitted as soon as possible after filing date.
Time Limits
Under PCT Chapter I: 30 months from the priority date
Under PCT Chapter II: 30 months from the priority date
A 33 time limit is applicable (under Chapter I and Chapter II) if the applicant pays the fee for requesting an extension of time for entry into the national phase.
Annuities
A maintenance fee is due annually on the anniversary of the international filing date and is payable before the granting of the patent. There is a 6-month grace period for late payment with a surcharge.
Protection Term
The term of protection is 20 years from the international filing date.
